This EULA is between you and Maksim Bulat, not Apple, and governs your use of the Sleeppy software application and related software components.
This EULA covers the license for the App itself. Your use of subscriptions, websites, AI features, and other service functionality is also subject to the Sleeppy Terms of Use and Privacy Policy.
Subject to your compliance with this EULA and applicable App Store rules, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the App on Apple-branded products that you own or control and as otherwise permitted by the usage rules that apply to your download method.
The App is licensed, not sold.
The App may download, install, or require updates, patches, or configuration changes. Some features may change, be suspended, or be discontinued at any time.
The App may rely on Apple services and third-party services, including Firebase, Google, and Amplitude. Third-party content and services are governed by their own terms and policies.
Your use of the App may involve local storage, cloud sync, family-sharing features, AI processing, purchases, notifications, analytics, and diagnostics. The Sleeppy Privacy Policy explains those data practices.
We, and not Apple, are solely responsible for any maintenance and support for the App, except to the extent applicable law requires otherwise.
To the maximum extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the App.
Our aggregate liability relating to the App will not exceed the greater of the amount you paid for the App and related in-app purchases in the 12 months before the claim or USD $50.
Nothing in this EULA limits or excludes liability that cannot legally be limited or excluded.
This EULA remains in effect until terminated. It terminates automatically if you fail to comply with it. You may also terminate it at any time by deleting the App from your devices and discontinuing use.
This EULA is governed by the laws of Poland, excluding conflict-of-law rules, subject to any mandatory consumer rights that apply in your country of residence.
